Welcome to Brim Town LLC ("Brim Town," "we," "our," or "us"). By placing an order with Brim Town, you agree to the following Terms & Conditions.

1. Orders

All orders are subject to acceptance and availability. Brim Town reserves the right to refuse or cancel any order at our discretion, including orders containing prohibited, offensive, or copyrighted artwork.

Once an order enters production, changes or cancellations may not be possible.

2. Custom Artwork & Customer Responsibility

Customers are responsible for ensuring they have the legal rights to any artwork, logos, images, or designs submitted to Brim Town.

By uploading artwork, you represent that:

You own the design or have permission to use it.
The design does not infringe on copyrights, trademarks, or other intellectual property rights.
The design does not violate any laws or regulations.

Brim Town is not liable for claims arising from customer-submitted artwork.

We do not print professional sports team logos, college team logos, or copyrighted material without written authorization.

3. Artwork Approval

Customers are responsible for reviewing proofs, previews, and order details before approving production.

Brim Town is not responsible for:

Spelling errors approved by the customer
Low-resolution artwork
Color differences between screens and printed products
Minor variations in placement or sizing

Custom products are produced as approved by the customer.

4. Production & Shipping Times

All production and shipping times are estimates and are not guaranteed.

Most orders are completed and delivered within 2–3 weeks from the date the order is placed, though many orders may arrive sooner. Production times may vary depending on order size, product availability, customization requirements, and seasonal demand.

Brim Town is not responsible for delays caused by:

Shipping carriers
Weather or natural events
Supplier or inventory shortages
Incorrect customer information
Circumstances beyond our reasonable control

If there is a significant delay with your order, we will make every effort to communicate updates as soon as possible.

5. Pricing

All prices are listed in U.S. dollars and are subject to change without notice.

Prices displayed on our website at the time of purchase are the prices that apply to your order.

Brim Town reserves the right to correct pricing errors, update product pricing, or discontinue products at any time.

Bulk discounts, promotions, and coupon codes cannot be combined unless specifically stated.

6. Returns & Refunds

Because most products are custom-made, all custom sales are final.

Returns or replacements may be offered if:

The wrong item was received
The item arrived damaged
The product contains a manufacturing defect
The finished product does not match the approved proof

Claims must be submitted within 14 days of delivery and must include photos of the issue.

Brim Town reserves the right to determine whether a replacement, store credit, or refund will be issued.

7. Shipping

Customers are responsible for providing accurate shipping information.

Brim Town is not responsible for:

Incorrect shipping addresses
Lost or stolen packages marked as delivered
Delays caused by shipping carriers

Shipping costs are non-refundable unless required by law.

8. Product Variations

Due to the nature of custom manufacturing:

Colors may vary slightly from digital images.
Hat materials and shades may vary by manufacturer.
Patch placement may vary slightly between products.
Leatherette, UV printing, and other specialty materials may show natural variations.

These variations are normal and are not considered defects.

9. Limitation of Liability

To the fullest extent permitted by law, Brim Town shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our products or services.

Our total liability for any claim shall not exceed the amount paid for the order giving rise to the claim.

10. Intellectual Property

All Brim Town logos, artwork, designs, product photos, website content, and branding are the property of Brim Town LLC and may not be copied, reproduced, or used without written permission.

11. Privacy

Information submitted through our website is used solely to process orders, provide customer service, and improve our services.

We do not sell customer information to third parties.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of Arizona.

Any disputes arising from these Terms or from purchases made through Brim Town shall be resolved in the appropriate courts located in Arizona.

13. Dispute Resolution

In the event of any dispute arising from the use of our website, products, or services, both parties agree to first attempt to resolve the matter through good-faith negotiation.

If a resolution cannot be reached, the parties may pursue mediation before initiating legal action.

Nothing in this section prevents either party from seeking immediate legal relief when necessary to protect its rights or property.

14. Age Requirement

By placing an order with Brim Town, you represent and warrant that you are at least 18 years of age or are placing the order with the consent and supervision of a parent or legal guardian.

15. Payment & Chargebacks

All orders must be paid in full at the time of purchase unless otherwise agreed upon in writing.

In the event of a chargeback, payment dispute, or fraudulent transaction, Brim Town reserves the right to:

Suspend or cancel the associated order;
Refuse future orders from the customer;
Recover any costs, fees, or expenses incurred in connection with the dispute, to the extent permitted by law.

16. Changes to Terms

Brim Town reserves the right to update, modify, or replace these Terms & Conditions at any time without prior notice.

Changes become effective immediately upon being posted on our website. Continued use of our website, products, or services following any changes constitutes your acceptance of the revised Terms & Conditions.
